Platform Privacy Policy

Your privacy is important to us. This Platform Privacy Policy (“Privacy Policy”) explains how MyOmnia Group Inc. TM (“we,” “us,” and “our”) collects, uses, stores, and shares your personal information in connection with your use, access, and other related interactions with our proprietary technology platform and related online services (collectively, the “Platform”).

Your use of the Platform means that you agree with this Privacy Policy and future changes to it. IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THIS PRIVACY POLICY, THEN YOU MUST NOT USE OR MUST STOP USING THE PLATFORM IMMEDIATELY.

Please know that if you, your affiliated organization, or an organization that is authorizing us to provide you with access to the Platform has executed a master services agreement with us (a “Master Agreement”), then the data ownership/licensing, privacy and security provisions in the Master Agreement apply to our use and disclosure of your information. To the extent the Master Agreement conflicts or is inconsistent with these Terms, the Master Agreement shall take precedence and control.

Who we collect information from

We collect information from the “Users” of our Platform, including you. You are a user. What information we collect about you, how long we store it, what we use it for, and who and for what purposes we share it with depends on the type of User and how you use our platform. The types of individuals we intend to use our Platform include:

  • Health care providers and organizations, such as mental or behavioral health providers (collectively, “Providers”), who provide health care, wellness, and other related health services (collectively, “Provider Services”) and who subscribe to the Platform. We refer to the individuals who are affiliated with such providers as “Provider Users.”
  • Individuals who are responsible for administering benefits or related services for the employers and other organizations who are clients of MyOmnia Group Inc. TM (each a “Client”). We refer to such individuals as “Administrative Users.”
  • Individuals who are the recipients of benefits or related services from our Clients and who are named on the rosters provided to us by our Clients. We refer to these individuals as “Client Users.”
  • Other individuals who are authorized by us, our Clients, or Providers to use the Platform. Such individuals, together with our Provider Users, Administrative Users and Client Users are the “Users” of the Platform.

What information we collect about you

We collect and store any information you share on the platform. The information we collect includes information that can identify you or your household (collectively, your “personal information”). Your personal information does not include any identified information we collect. You may choose not to provide information to us, but certain information (including personal information) will be collected each time you visit the Platform. The information we collect about you may include, but is not limited to, the following categories of information:

Please know that deidentified data is not your personal information. Deidentified data is information that does not contain any personal information about you or your household and for which there is not a reasonable basis to believe that it can be used to identify you. We may use and disclose deidentified data as permitted by the laws and contracts that apply to us. For more information, please read the section below on our commitment regarding deidentified data.

How the Platform may access other applications and data on your devices

With your permission, the Platform may request access to other data or applications on the device or browser you choose to connect to the Platform, such as your device’s camera, photo library, contacts, location services, defaults (such as Siri and Search, Notifications, Background Platform Refresh, Cellular Data, and Storage), phone dialing, or text messaging application (such as your “Short Message Service” or “SMS”). You can withdraw your permission by accessing the Platform in your device's or browser’s settings.

For what purposes we collect, store,and use information about you

We use your personal information and other information we collect on the Platform to operate the Platform, to provide services to you, to fulfill the purpose(s) for which you provided the information to us, and to support treatment, payment, and healthcare operations activities. We may also use your personal information as permitted or required by the laws that apply to us, including without limitation the following:

  • For any Purpose Authorized by You or Your Legally Authorized Representative.
  • Connecting Client Users to Provider Services. For example, if you are a Client User or other User seeking to connect with a Provider, we use your information to facilitate data sharing between you and your Provider so you can get help when you need it. For example, the onboarding questionnaire we ask you to complete during your account registration gives us information on your personal preferences for Providers and Provider Services.
  • Facilitating Platform Tools. We need to process certain data to enable certain features and functionality within the platform. These tools help us facilitate a more effective experience and outcome.
  • Communicating with You. For example, we use your information to make sure we respond to and address any questions or concerns you may have about the Platform. If you are an Administrative

User, Provider User, or other User who is accessing the Platform in a professional capacity on behalf of an organization, we may contact you in your professional capacity to service your organization's account, answer questions, and provide support.

  • Providing You with Information About Our Platform and Services. To the extent permitted by the laws that apply to us, we may use your information to send you email, phone, or SMS reminders, notifications, and updates about the Platform, your use of the Platform, your profile, or your account. With your permission, we may use your information to email you offers, special promotions, or discounts, and other forms of advertising or marketing communications; and if you engage with us in a professional capacity on behalf of an organization, we may email promotions, discounts, and content that we think might be relevant to your organization. With respect to provider users, we may use your information to determine whether you are eligible to subscribe to our platform, to match you with clients based on your professional expertise, and to facilitate communications.
  • Personalizing your Platform Experience. We use information on your preferences to determine how to improve your individualized experience of the platform.
  • Monitoring and Protecting the Platform Security. We may use your information to make sure only you can access your account on the Platform, to place controls or challenges to prevent unauthorized access, to issue security patches and bug fixes, to track potential abuse on the platform, to prevent and detect security incidents, to protect against malicious, deceptive, fraudulent, or illegal activity, or to prosecute those responsible for such activities.    
  • Monitoring and Improving Quality of the Platform and Provider Services. To ensure the quality of the Platform as well as of our Providers and their Provider Services, we may review your correspondence with us and your Providers for quality assurance purposes, including if you raise a concern about your Provider or we have concerns about a specific Provider’s care. We may also review your correspondence with providers if we have a reason to believe there is a security, legal, or fraud issue occurring with that specific account. We may also use information to understand how we can improve the Platform, such as determining if resources should be applied to existing, popular features or new features, or whether to remove old features no longer providing value.
  • Performing Data Analytics. For example, we may aggregate personal information about you with other user information to provide insights into the effectiveness of the platform and Provider Services. 
  • Complying with Applicable Laws and Enforcing our Terms of Use. We collect information required to satisfy certain legal requirements and to enforce our Terms of Use.
  • Protecting our Users, Property and Platform.
  • Performing Other Legitimate Business Interests. We may use your information for the proper management and administration of our business                                        

We may use deidentified data for any purpose permitted by applicable law.

With whom may we share your information

We may share your information, including personal information, as permitted or required by the laws that apply to us, including, without limitation, with:

  • Anyone Authorized by You or Your Legally Authorized Representative.
  • Our Workforce and Affiliated Organizations.
  • Your Providers. For example, if you are a Client User we will share your information with the Providers who you choose to engage with in connection with the Platform. If you are a provider

User providing Provider Services, we may share your information with other members of the Client User’s care team to facilitate care coordination.

  • Clients Affiliated with You. For example, if you are a Client User who is using the Platform in connection with your employment or engagement by one of our Clients, we may share certain limited information about your use of the Platform with that Client to provide the Platform to you and to facilitate, if applicable, the Client’s payment for Provider Services you may use. We may also share aggregated and fully de-identified group-level usage data with our clients.
  • People Who Help Us Provide the Platform. We may share your information, including personal information, with our business partners, contractors, and third-party service providers engaged to help us operate the Platform and promote our business (collectively, “Service Providers”). Please see the section on Our Service Providers below for more information.

We may share your personal information and other information we collect on the Platform to operate the Platform, to provide services to you, to fulfill the purpose(s) for which you provided the information to us, and to support treatment, payment, and health care operations activities. We will not sell your personal information to advertisers or other third parties without your permission.

We may also share your personal information and other information for the following purposes:

  • Protecting our Users, Property and Platform. For example, if we have reason to believe that you or any other person may be in immediate danger or your privacy has been infringed upon, we may use the information to investigate or reach out to you or the appropriate authorities if it is legally appropriate or permitted to do so.
  • Legal Process, Obligations, and Rights. We may share your information to respond to subpoenas, court orders, or law enforcement requests; to establish or exercise our legal rights or defend against legal claims; or as otherwise required or permitted by applicable law.
  • Company Sale or Bankruptcy. We may share some of your data with prospective buyers of MyOmnia Group Inc. TM or any other successors in the event of a merger, divestiture, restructuring, reorganization, change of control, dissolution, or other sale or transfer of some or all of our assets, including as part of a bankruptcy, liquidation, or similar proceeding.         

We may share deidentified data for any purpose that is permitted by applicable law. 

Our Service Providers

We may share your information, including personal information, with our Service Providers in connection with platform operations and our business. Examples include:

  • Data Hosting and Storage Providers. For instance, we use Amazon Web Services (AWS) to host the infrastructure underlying the Platform.
  • Technology Service Providers. Examples include third parties who integrate tools into the Platform to give it more functionality, like technology that helps us provide live audio, video, and group meetings, or who otherwise help us ensure the safety and security of the Platform and that of our users.
  • Customer Service Providers. Examples include third parties who integrate their tools into the Platform to keep track of your requests and questions in a secure way.  
  • Email Management and Communication Service Providers. Examples include third parties with tools that we use to help us communicate with you more easily, efficiently, and expeditiously.
  • Marketing and Advertising Service Providers. If permitted by applicable law and you, we may also work with marketing and advertising service providers.
  • Recruiting Providers. If you are a Provider User, we may also share certain information you voluntarily provide on the Platform, such as your name, photograph, credentials, experience, specialties, and qualifications, with recruiters to facilitate, monitor, and track our recruitment process.
  • Billing and Payment Processing Service Providers. Examples include third parties who help process payments in a secure way. These vendors also help us pay providers and issue tax documents to them. For this reason, we may share your email address with these vendors and other data that is needed to pay providers, such as a provider’s name and tax ID.    
  • Reporting and Analytics Service Providers. Examples include third parties who keep track of those platform webpages and features that are most used.
  • Financial, Regulatory, and Legal Advisors. Examples include third-party financial advisors we engage for accounting and financial planning activities or any third-party regulatory or legal advisor who we engage to advise us on business and other legal matters, or otherwise to help us remain in compliance with applicable law.                                         

Text messages and push notifications

We may use your information to send you periodic emails or text messages. In some cases, these communications are delivered to facilitate the provision of provider services or are directed not by us but by a provider user, client user, or other user of the platform. Other times, they may be to provide marketing communications, if you have consented to receive marketing communications. You may receive these notifications through any electronic means of communication, including email or your device’s SMS (or other text messaging application) and notification features. These communications may not be secure (not encrypted). There are risks associated with unsecured communications that you should consider. These risks include (without limitation) that an unauthorized person may get access to and read these communications. By using the Platform, you are agreeing to accept these risks and consent to receive secure communications.

If you wish to opt out from receiving push notifications, you may turn them off in your device's settings. You may also opt out by replying “STOP” in response to a text message. This opt-out process does not apply to live phone calls or emails, which may continue if we need to reach you.

How long we store (retain) your information

We may store your information for as long as your information is needed in connection with your access and use of our Platform and to the extent necessary to comply with our legal and contractual obligations (for example, if we are required to retain your data to comply with laws that apply to us), resolve disputes, and enforce our legal agreements and policies.

Our commitment regarding deidentified data

We take reasonable measures to ensure that the deidentified data that we collect or create cannot be associated with you or your household. When we collect or create deidentified data we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information unless we are permitted to do so by applicable law.

Website browsers and do not track (DNT) signals

Some website browsers have a “do not track” (DNT) feature that lets you tell other websites that you do not want to have your online activities tracked. No uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to a browser’s DNT signal. We are not aware of, and do not knowingly allow, such third parties to track your activity over time on the Platform. However, we may share information about your platform/usage with others as described in this privacy policy.

Pixels, cookies, and web beacons

We may use technologies like pixels, cookies, and web beacons (collectively, “Cookies”) to perform certain tasks, such as to help connect Client Users with Provider Services, personalize your experience, comply with laws, improve, monitor, and analyze usage of the Platform, deliver faster and safer experiences, and (if permitted by applicable law) for advertising purposes, as described below.

  • Necessary Cookies. We use this technology for the platform to operate and function. This technology allows us to regulate and monitor user experiences, assess attribution internally, control data ingress, provide security, and comply with laws and your indicated preferences.
  • Analytic/Functional Cookies. We use this technology to perform data analytics. For example, this technology allows us to work with service providers to process data related to traffic sources, visits, and site interaction.
  • Advertising Cookies. If permitted by applicable law, we may use this technology for personal advertising and to measure the effectiveness of advertising. In doing so, we are able to reach more people who may be looking for our services or services we support while minimizing our advertising costs, which helps us to reduce the costs of our services. Additionally, our service providers may use your data to build a profile of your interests and show you relevant advertisements on other sites. If you opt in to this technology, limited personal information about you (such as visit information) may be shared for advertising purposes. If you opt out of this technology, you may experience less personalized and useful advertising.              

Social media

We may engage with you on third-party social media sites like Instagram, Facebook, LinkedIn, or X (formerly Twitter). If you engage with us on social media, you “opt in” to sharing your social media content with us. Be aware that the content you submit to social media sites (uploads, posts, comments, shares, "likes,” and any messages or tweets) will be publicly visible. To manage the social media notifications you receive or to adjust your privacy settings on your social media accounts, please access the profile section of your social media accounts and follow the directions there.

Artificial intelligence (AI)

We may use artificial intelligence (AI), machine learning engines or systems, neural networks, or similar systems (collectively “AI Capabilities”) to support and develop features and functionality of our platform and to improve the quality of our services. For example, we may use AICapabilities to detect security risks, synthesize information for customer service agents, and help provider users manage and document sessions more effectively. We expect use of these AI Capabilities to ultimately improve our platform and experiences for all our users. By using our platform, you acknowledge and agree that your personal information and deidentified data derived from your personal information may be processed by these AI Capabilities in accordance with this Privacy Policy.

Your information and HIPAA

HIPAA refers to the federal Health Insurance Portability and Accountability Act and its implementing regulations. HIPAA protects the privacy, security, and accessibility of protected health information maintained by or on behalf of certain HIPAA-covered entities, such as health plans and health care providers who submit certain electronic transactions to health plans. MyOmnia Group Inc. TM is often a HIPAA business associate of its providers and clients and often offers its platform to client users and other users on their behalf. Accordingly, we apply HIPAA protections to all individually identifiable health information maintained on our platform.

Please also know that when we provide the Platform to a User on behalf of a Provider or Client who is regulated under HIPAA, the Provider or Client may internally use and externally disclose the User’s personal information and other information with others if they are permitted to do so under HIPAA and other laws that apply to them. We cannot control how a user’s health plan, health care provider, or other people who work with them use or share the user’s personal information or other information. Users should read their health plans and health care provider’s HIPAA Notice of Privacy Practices for more information about how their protected health information can be used and disclosed under HIPAA. If you have any questions or concerns about how your health plan or health care provider is managing your information, please contact them directly.

Security for your personal information

We take reasonable steps to keep your personal information secure and to protect against the loss, misuse, or alteration of your personal information on the Platform. Although we have these security measures in place on the platform, it cannot guarantee your privacy. Please also be aware that not all electronic communications you might use to engage with us or the platform are secure (encrypted). For example, your personal email and text messaging on your device’s SMS (or other text messaging applications) are not secure (not encrypted) methods of communication. There is a risk that such email messages and text messaging on your device’s SMS (or other text messaging applications) could be intercepted or read by other people. Please do not use unsecure electronic communications to communicate with us about confidential matters. By using the Platform, you agree to accept these risks and consent to receive unsecure communications when you communicate with us through unsecure communications or if you enable Platform features or functionality that engage with your personal email, SMS, or other text messaging applications.

Using the Platform outside of the States

We intend the Platform to be used by residents of the United States in (and only in) the United States. This platform is not intended for use by individuals who are not located in the United States. If you are visiting our website or using the Platform from outside the United States, please be aware that your personal information and other information will be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. The data protection and other laws of the United States might not be as comprehensive as those in your country. By using our website or Platform, you understand that your personal information and other information may be transferred to our facilities in the United States and those third parties with whom we share it as described in this Privacy Policy.

Third-party links

The Platform may contain links to websites that are owned or operated by third parties. If you click on a third-party link, you will go to that third-party website. We do not have control over third-party websites, and those websites do not operate under this Privacy Policy. You should review the privacy policies of third-party websites before using them.

Children’s privacy

Our Platform is not directed at and not intended to be used by any children under the age of majority (which in most states is 18). You must not use the Platform if you are under the legal age of majority—18 years of age. We do not knowingly collect or solicit any information from users under the age of 18 or knowingly allow such users to use the Platform. Children under the age of 18 may request that any information posted to the Platform be removed by contacting us at the information provided below. Removing information posted to the Platform does not guarantee complete or comprehensive removal of the content or information posted.

Correction of information, cancellation, misuse of information

Please contact us, using our information below, to:

  • Request that we correct, delete, or change personal information;
  • Obtain a copy of the personal information we maintain about you;
  • Request that place restrictions on whether or how we collect, use or share your personal information;
  • Cancel your participation, or
  • Report misuse or an unauthorized disclosure of personal information.

Please know that it might not be possible for us to correct, delete, or change personal information that has already been shared. Deleting information posted to the Platform does not guarantee complete or comprehensive removal of the content or information posted.

Please contact us immediately if you believe there is any non-compliance with this Privacy Policy.

Platform Terms of Use

Your use of the Platform is also subject to the Platform Terms of Use. Any disputes related to this Privacy Policy will be governed by the applicable provisions of the Platform Terms of Use, which are incorporated into this Privacy Policy by reference.

Privacy Policy changes

We may change this Privacy Policy at any time and for any reason. We encourage you to periodically review this page for the latest information. We may notify you of material changes through the Platform, by email, or by a push notification to the mobile phone number you provided to us. By agreeing to this Privacy Policy, you agree to receive such notifications. You can access the most current version of the Privacy Policy that applies to your use of the Platform through the Platform. You can also contact us, using the information below, for a copy.

Unless otherwise specified by us, all changes will be effective upon being updated in the Platform. You should look at this Privacy Policy on a regular basis. The most recent “Last Updated” date is posted at the top of this Privacy Policy. You agree to any changes to the Privacy Policy by your continued use of the Platform after that date. If you do not agree to the changes, you must stop using the Platform.
